Catastro: Certificado y cédula, es lo mismo?

Quizás alguna vez se presentó en el devenir de la profesión, aunque si bien es el mismo Poder Judicial que a veces no hace docencia, si no que confunde en ocasiones con la disparidad de criterios (tantos como jueces hay en cada departamento judicial), la esencia de cada tramite que son FUNDAMENTALES a la hora de lograr, por ejemplo, la famosa orden de inscripcion judicial de una declaratoria.

En ocasiones el propio juez no especifica y utiliza sin distinción “cédula”, “cédula catastral” o “certificado catastral”.

Para cada denominación citada hay una definición exacta, he aquí la solución a los resultados equívocos a la hora de pedir tal o cual trámite.

En primer lugar, es el Departamento de Catastro y Geodesia, dependiente de la Agencia de Recaudación de Buenos Aires, la encargada de prestar toda la información. Toda ella esta a su cuidado y atención, la cual pagando la correspondiente tasa y reuniendo los requisitos necesarios, se logra la liberación de la información correspondiente.

El Certificado Catastral

Dado que es imposible confundírselo, este es el mas importante distingo entre todas las otras denominaciones utilizadas en el ámbito judicial: el Certificado Catastral Ley 10707 es el que todo profesional letrado debe aspirar, para lograr el auto de inscripción.

Comunmente se lo denomina Cedula Catastral, Cedula de Catastro o simplemente Estado Parcelario.

Fundamental: para poder pedir a ARBA este trámite, debe indefectiblemente existir un estado parcelario VIGENTE. Esto es, que el cliente haya hecho en los últimos 3 años al menos, mediante un profesional agrimensor, la presentación correspondiente del Estado Parcelario. De no existir, y si solicitase un Certificado Catastral al no haber estado parcelario, ARBA no solo le tomará el tramite, lo cobrará y le devolverá rechazado con la nota del Artículo 7 de la citada ley.

Sin estado parcelario, no hay Certificado Catastral Ley 10707

La Cédula Catastral

Dentro del ámbito judicial, no parece haber distingo entre una cosa y la otra. Lógicamente, una cosa es Certificado y otra muy distinta es una simple cédula.

Cuando una persona necesita pedir un informe de dominio, es indispensable tener la correspondiente copia de la escritura de dominio: dada la especial naturaleza de dicho documento, no siempre se tiene acceso a la misma: porque no desea poner a disposición la misma, o simplemente porque directamente, no la tiene.

Ante la ausencia, por el motivo que sea, de la escritura, entra en juego la cédula catastral

Por lo tanto, la cédula nos proporcionara los datos que una escritura tiene, y nuestro cliente no. Especificamente, para pedir un dominio necesita contar con los siguientes elementos:

  • Nomenclatura catastral
  • Partida inmobiliaria
  • Titular o titulares de dominio
  • Inscripcion de dominio (matrícula o Folio)
  • Medidas del lote
  • Superficie
  • Linderos
  • Si corresponde, plano y sus indicadores de año y seccion.

COVID-19: Situación a Enero/2021

Como ya sabia probablemente, desde Marzo 2020 toda la actividad profesional, incluida la jurídica y desde ya todo lo relacionado a ella, se vio ampliamente afectada por la pandemia mundial del Corona Virus. A la fecha todavía no sabemos como continuará la situación luego de la Feria Judicial del Año 2021.

El propósito de este apartado de novedades, será mantener informados al publico en general y nuestros clientes, de todas las novedades que ocurran relativas o no al COVID19, que afecten el normal desempeño tanto de abogados, procuradores y publico en general.

Algunas de las novedades mas destacadas son:

  • ARBA: a la fecha, todavía no tiene atención al publico, por lo que tramites tan importantes como la Liberación de Catastro, requisito fundamental para dar inicio a Inscripciones de Declaratoria de Herederos, continua sin poder realizarse.
  • REGISTRO PROP. INM PCIA: Desde Marzo 2020, no tiene a disposición de quien solicite, publicidad registral URGENTE (48-72 hs.) y EN MANO.

Feria Judicial 2021 en Provincia de Bs. As.

COVID-19 (Coronavirus). Mantenimiento de las condiciones y alcances en la habilitación y funcionamiento del servicio de justicia hasta el 5 de febrero de 2021.

A través de la Resolución SPL Nº 72/20, la presidencia de la Suprema Corte de Justicia dispuso mantener hasta el 5 de febrero de 2021 inclusive las condiciones y alcances de habilitación y funcionamiento en las cabeceras departamentales, sedes descentralizadas y Justicia de Paz vigentes.

Lo dicho, más allá de las adecuaciones y ajustes que pudiesen incorporarse para la mejor prestación del servicio de justicia, o el dictado de nuevas resoluciones o decisiones en contrario, motivadas en la eventual reversión de la situación dada en oportunidad del dictado de la presente.

En detalle, a los fines de la prestación efectiva del servicio de justicia provincial, se sostiene la siguiente normativa:

1) Continuidad de la situación de excepción reglada por la Resolución SC Nº 480/20, sus ampliatorias y complementarias;

2) Habilitación y funcionamiento de la actividad jurisdiccional y administrativa, en función de las pautas previstas en las Resoluciones SC Nº 583/20 y Nº 655/20;

3) Régimen especial instituido por las Resoluciones SC Nº 1250/20 y Nº 1251/20.


Asimismo, se hace saber que para el período de feria estival comprendido entre el 1º y el 31 de enero de 2021 se aplicará el esquema aprobado por el Acuerdo 3998– y sus normas complementarias ampliatorias y modificatorias-, que establece el cronograma de organismos que quedarán cubriendo el servicio de feria; reanudándose el 1º de febrero la prestación en las condiciones establecidas en la normativa enunciada en los puntos 1 a 3.
